Housing Appeal Process
Any person affected by any order or notice which has been issued in connection with inspections under the Existing Residential Structures Code has the right to appeal and will be granted a hearing before the Housing Board of Appeals. The person who is appealing would write a letter to the Deputy Code Official requesting a variance. Deadline for the request is 15 days prior to meeting date. Meetings are held the second Wednesday of the month, when appeals are received.
An appeal stays all proceedings in furtherance of the action appealed from unless the Enforcement Official certifies to the Board that a stay would, in his opinion, cause imminent peril to life or property.
Deputy code Official submits to the Board any and all documents pertaining to the appeal, notifying them of meeting date and time and nature of appeal.
Board will hear all information from the Deputy Code Official at the meeting. Petitioner will present his/her appeal and Board has the opportunity to question petitioner, and then will decide to either grant or deny the variance. If sufficient information has not been received at that time, appeal for variance can be tabled until Board feels they have enough information to make a decision.
